GENERAL TERMS AND CONDITIONS OF SALE

Mind Tree Coaching

These General Terms and Conditions of Sale (the “GTC”) govern all sales made through the website  www.mind-tree-coaching.lu  (the “Site”), operated by Mind Tree Coaching, which offers coaching-related products and services, including offers intended for businesses (“Corporate”) and for individuals (“Private”), namely Webinars, E-learning courses, and Coaching sessions.

Placing an order on the Site implies full and unreserved acceptance of these GTC by the Customer.

Article 1 — Identification of the Seller

The Site is published and operated by:

Hereinafter referred to as the “Seller” or the “Company”.

Article 2 — Scope

These GTC apply to all sales of products and services offered on the Site, including in particular:

  • Corporate offers: coaching, training, or consulting services intended for businesses;
  • Private offers: Webinars (live and/or replay sessions), E-learning modules (self-paced digital content), and individual Coaching sessions.

The Seller reserves the right to amend these GTC at any time. The applicable GTC are those in force on the date of the order.

Article 3 — Products and Services

3.1 Corporate Offers

Corporate offers consist of coaching, training, or consulting services intended for professionals and businesses.
Their content, duration, terms, and pricing are specified on the relevant product page or in a dedicated commercial proposal/quote.

3.2 Private Offers
  • Webinar: a group training or coaching session delivered online, live and/or available as a replay, as specified on the product page.
  • E-learning: digital training content that the Customer can access independently after payment, for a duration specified on the product page.
  • Coaching: individual or small-group support, delivered online or in person, according to the terms agreed upon at the time of order.

The essential characteristics of each product or service are described on the Site prior to any order confirmation by the Customer.

Article 4 — Price and Payment Terms

Prices are stated in euros (EUR), inclusive of all taxes, unless otherwise stated for Corporate offers, which may be presented exclusive of tax (net) as part of a specific commercial proposal.

Payment is made in a single instalment, in full, at the time the order is confirmed, using the payment methods offered on the Site.

The order is considered final only upon receipt of payment confirmation by the Seller.
A confirmation email is sent to the Customer’s email address.

The Seller reserves the right to suspend or refuse any order in the event of non-payment, partial payment, or any payment incident.

Article 5 — Order

The Customer selects the desired product(s) and/or service(s), provides the necessary order information, and proceeds with payment.
By confirming the order, the Customer acknowledges having read and unreservedly accepted these GTC.

The Seller reserves the right to cancel or refuse any order from a Customer with whom a dispute exists regarding payment of a previous order.

Article 6 — Right of Withdrawal

6.1 General Principle

In accordance with applicable distance-selling legislation, a consumer Customer is, in principle, entitled to a fourteen (14) day withdrawal period from the conclusion of the contract, without having to justify any reason or pay any penalty.

6.2 Waiver of the Right of Withdrawal — Digital Content and Immediate-Access Services (Webinar, E-learning)

For E-learning and Webinar products, access to the content is made available to the Customer immediately upon payment confirmation.

By confirming an order for an E-learning or Webinar product, the Customer expressly acknowledges and agrees to receive immediate access to the digital content, and thereby expressly and fully waives their fourteen (14) day right of withdrawal, given that performance begins with the Customer’s consent.

Accordingly, once the order has been confirmed and access to the content has been granted, no withdrawal or refund may be claimed by the Customer under the statutory right of withdrawal for E-learning and Webinar products.

6.3 Coaching (Service Provision)

For Coaching services, the right of withdrawal may likewise no longer apply once the service has been fully performed, or has begun with the Customer’s express consent prior to the expiry of the 14-day period.
Any session already delivered is due in full and shall not be refunded on this basis.

Article 7 — Cancellation and Rescheduling by the Customer

For services delivered on a fixed date (live Webinar, Coaching sessions), the Customer may request to reschedule their participation to a later date, subject to the availability communicated by the Seller.

No refund will be granted in the event of cancellation by the Customer, regardless of the reason.
Only a rescheduling of the service to a later date may be offered, subject to a request sent by email to alexandra@mind-tree-coaching.lu within a reasonable time before the scheduled date of the service.

The Seller reserves the right to set a maximum number of reschedulings per order, as well as applicable request deadlines, as specified on the product page or communicated to the Customer at the time of order.

Article 8 — Access and Availability of Content

For E-learning products, access to the content is granted for a specified period, indicated on the product page at the time of purchase.
After this period, access to the content may be suspended, without giving rise to any right to a refund.

The Customer is responsible for the confidentiality of their login credentials and may not share, resell, or distribute access to the content to any third party.

Article 9 — Intellectual Property

All content provided on the Site and as part of the services (texts, training materials, videos, presentations, methodologies, E-learning documents, etc.) remains the exclusive property of the Seller or its partners and is protected by copyright and intellectual property law.

Any reproduction, distribution, representation, resale, or exploitation, in whole or in part, of the content, without the Seller’s prior written consent, is strictly prohibited.

Article 10 — Liability

The Seller undertakes to use all reasonable means to ensure the quality and availability of its services. However, the Seller’s liability shall not be engaged in the event of:

– temporary malfunction of the Site or the tools used for Webinars (video-conferencing platform, hosting, etc.);
– non-performance or improper performance of the contract attributable to the Customer, a third party, or an event of force majeure;
– results obtained (or not obtained) by the Customer as a result of coaching or training, these services being subject to an obligation of means and not of result.

Article 11 — Personal Data Protection (GDPR)

Personal data collected during the order process is processed by the Seller in accordance with the General Data Protection Regulation (GDPR) and applicable Luxembourg law, solely for the purpose of managing the business relationship, fulfilling orders, and, where applicable, sending commercial communications with the Customer’s consent.

The Customer has the right to access, rectify, delete, and object to the processing of their personal data, which may be exercised by writing to alexandra@mind-tree-coaching.

Article 12 — Complaints and Disputes

For any complaint, the Customer may contact the Seller at alexandra@mind-tree-coaching.lu.
The Seller undertakes to respond within a reasonable timeframe.

In the event of a dispute not resolved amicably, the consumer Customer may resort to a consumer mediation procedure, under the conditions provided for by Luxembourg legislation.

Article 13 — Governing Law and Jurisdiction

These GTC are governed by Luxembourg law.
In the event of a dispute, and failing an amicable resolution, the Luxembourg courts shall have sole jurisdiction, subject to any mandatory provisions applicable to consumer protection.
